2008 Official Raffle Rules©

These rules govern the raffle and are binding on every ticket buyer and person named in a ticket.

RAFFLE PRIZES: At least 100 prizes will be awarded, including:

GRAND PRIZE: the home or $1,000,000 cash (winner’s choice)
2nd Prize:   $20,000 cash  or 2009 Toyota Corolla (winner's choice)
3rd Prize:    $10,000 cash
4th Prize:    $ 5,000 cash
5th Prize:    $2000 cash or 50-inch Plasma TV (winner's choice)
6th - 10th Prizes:   $500 cash each
11th - 48th Prizes: $300 cash each
49th - 75th Prizes: Apple iPhone or Apple iPod. Value $400. (There is a limited supply of each prize. Winners may choose their prize as long as both items are available.)
76th – 85th Prizes: Nintendo bundle

RAFFLE PURCHASE DEADLINES: 

Pre-Launch Early Bird:  Ticket purchase deadline: Monday, June 23; Drawing: Saturday, June 28, 2008 
Second Early Bird:  Ticket purchase deadline: Thursday, July 24; Drawing: Thursday, July 31, 2008
Third Early Bird: Ticket purchase deadline: Thursday, August 21; Drawing: Monday, August 25, 2008

Bonus Drawing: Ticket purchase deadline September 18, 2008. Drawing time and place TBD.
NEW EXTENDED GRAND PRIZE DEADLINE: Grand Prize, Multi-Ticket Buyer prizes, and all other remaining prizes: Ticket deadline for purchases by phone or by fax is 5 p.m. Thursday, October 2. Mailed orders must be postmarked by Monday, September 29, 2008 in order to guarantee their entry into the drawing.   Drawing: October 3, 2008

The raffle may sell out before a deadline.  Tickets purchased by a deadline qualify for all future drawings.  Deadlines may be extended at INNVISION’s discretion without notice. 

RAFFLE DRAWING DATES, TIMES, AND LOCATION: 

Pre-Launch Early Bird Drawing:  Saturday, June 28, 2008 at the Penthouse, City Heights, 175 West St. James Street, 15th floor, San Jose (check website for exact time of drawing)
Second Early Bird Drawing: Thursday evening, July 31, 2008, (check website for location and exact time of drawing)
Third Early Bird Drawing : Monday , August 25, 2008 at the San Jose Giants game, Municipal Stadium, 588 East Alma Ave. in San Jose. Look for the Silicon Valley Home Raffle table inside the front doors starting at 6PM to buy raffle tickets for this drawing. Game time is 7PM.

Bonus Drawing: Time, Date and Place TBD.
Grand Prize, Multiple Ticket Buyer Prize Drawing, and all other prize drawings: 9:30 p.m. on Friday, October 3, 2008 at the InnVision Gala

Everyone is welcome to attend the early bird drawings.  The Grand Prize/Multiple Ticket Buyer Prize Drawing will be held during the InnVision the Night Gala and the cost to attend is $150 per person. Winners need not be present.

WHO CAN BUY RAFFLE TICKETS:

Ticket buyers and persons named on a ticket must be at least 18 years old upon purchase.  Tickets can only be purchased in the name of individuals (not businesses).  The following people can purchase tickets that name other individuals but cannot be named on a ticket:

1. Employees and board members of INNVISION; and
2. Employees of Big Bang Fundraising, LLC, a California LLC.

HOW TO BUY RAFFLE TICKETS:

In person or by mail: INNVISION, 974 Willow Street, San Jose, California 95125. 

Tickets cost $150 each. A ticket purchase is not tax-deductible.  Tickets can be purchased by check/money order payable to INNVISION or by credit card (Visa, MasterCard, American Express).  Credit card purchases must include the name on the card, expiration date, and security code. Tickets cannot be purchased by voicemail or over the internet.  Do not mail cash. 

A ticket can be purchased in the name of one, two or three individuals.  If more than three names are on an entry form, then the first three names listed (as determined by INNVISION) will be deemed the holders of that ticket.  The ticket receipt will be mailed to the first person listed on the entry form.  Any prize and related tax liability belongs 100% to one person named on a ticket or 50% to each of two persons named, and 33-1/3% to each of three persons named.

Entry forms deemed by INNVISION to be defective, illegible or submitted without good funds may not be honored.  INNVISION assumes no responsibility for lost, misdirected, late or non-delivered mail or other failure to timely purchase tickets, or for notifying anyone who attempts to purchase a ticket with a defective or illegible ticket or without good funds.  All sales are final.  No payments will be refunded, including payments received from ineligible parties, except at INNVISION’s discretion.  This raffle is void where prohibited by law.

THE DRAWINGS:

Winning tickets will be drawn at random by INNVISION.  The odds of winning a prize depend on the number of tickets in each drawing.  If all 18,000 tickets are sold, then the odds of a ticket winning the Grand Prize are 1 in 18,000.  Odds of winning a prize improve if fewer than 18,000 tickets are in a drawing and if more than one ticket is purchased.

At each Early Bird Drawing, a ticket will be drawn for 4th prize, then 3rd prize, then 2nd prize, then 1st prize.  No ticket can win more than one prize in each early bird drawing.

The Multiple Ticket Buyer Drawing rewards those who buy more than one ticket.  Buy 2 tickets with the same name(s) and address and you receive one entry in the Multi-Ticket Drawing; buy 3 tickets and you receive two entries in the Multiple Ticket Buyer Drawing, etc.  At the Multiple Ticket Buyer Drawing, eligible tickets will be drawn, beginning with the lowest value prize and ending with 1st prize.  No ticket can win more than one prize in the Multiple Ticket Buyer Drawing.

At the Grand Prize Drawing, tickets for all prizes except the Grand Prize will be drawn first, in reverse order, prize 85 first and 2nd prize last.  Then, those winning tickets will be re-entered with all other tickets in the Grand Prize Drawing.  No ticket can win more than one of prizes 2 through 85.  It is possible for one ticket to win one prize in each Early Bird Drawing, one Multiple Ticket Buyer prize, one of prizes 2 through 85, and the Grand Prize.

MAXIMUM AND MINIMUM TICKETS:

A maximum of 18,000 tickets will be sold.  If less than 15,000 tickets are sold by the final deadline, then all prizes will be awarded except the Grand Prize winner will receive one half of the “net raffle proceeds,” defined as the balance of ticket sales revenue remaining after payment of all other prizes (whether or not claimed or awarded) and all raffle-related expenses as determined by INNVISION, which shall be final and binding. 

RULES APPLICABLE TO ALL TICKET BUYERS AND ALL PRIZE WINNERS:

INNVISION will make reasonable efforts to contact winners using the information on the winning entry form.  If a winner cannot be located within 30 days after the drawing, or if any person is ineligible under these Rules or applicable law, then he/she will not be awarded the prize; no other ticket will be substituted for that ticket and the prize will be retained by INNVISION.  Any prize winner may elect to not accept a prize, in which case the prize will become the property of InnVision.

 A prize winner may take an income tax deduction for donating a prize back to InnVision only if the prize winner accepts the prize from InnVision, reports the receipt of the prize on the prize winners’ federal and state income tax returns, and pays all income taxes applicable to the receipt of the prize. 

Any prize not claimed within 60 days after that prize’s drawing will not be awarded. A person named on a ticket can not transfer his/her interest in the ticket. 

Each winner is solely responsible for timely paying and reporting all taxes and expenses attributable to the prize, whether or not INNVISION withholds taxes or complies with withholding laws.  Winners authorize INNVISION to withhold all required amounts and shall indemnify, defend, protect and hold harmless INNVISION from all related claims.

Each winner agrees his/her name, likeness, voice and city of residence may be recorded by audio, video, or digital means and may be used in any print, audio or visual media without notice or compensation for any purpose, including related to this or any other INNVISION raffle.

Each winner, as a condition to being eligible to receive a prize, must sign and deliver to INNVISION: (a) a sworn affidavit of eligibility under these Rules and applicable law; (b) any information required by applicable law, including Social Security Number; (c) satisfactory proof the winner is 18 or older and is the person named on the winning entry; and (d) a publicity release.

Each person who purchases a ticket and/or whose name appears on a ticket: (a) agrees INNVISION, its directors, officers, employees, agents, representatives and the home seller are not responsible for any injuries, losses or damages of any kind arising in connection with, or as a result of this raffle and/or that person's failure to win or redeem any prize, or that person's award of, acceptance of or use of, any prize; and (b) releases and agrees to indemnify, defend, protect, and hold harmless INNVISION and the home seller and their officers, directors, shareholders, employees, agents, advertising agency, contractors, insurers, attorneys, accountants and affiliated entities from and against all losses, damages, rights, claims and actions of any kind arising in connection with, or as a result of, this raffle and/or that person's failure to win or redeem any prize, or that person's award of, acceptance of, or use of any prize; and (c) represents and warrants to INNVISION that he/she has read and understands these Rules and agrees to be bound by these Rules and INNVISION’s decisions, which are final.

RULES APPLICABLE TO THE GRAND PRIZE WINNER:

To receive the home, the Grand Prize winner must elect to receive it, instead of the alternate cash prize, by delivering written notice to INNVISION within 16 days after the drawing date.  To be effective this notice must be signed by everyone named on the ticket.  If INNVISION does not timely receive  this notice, then the Grand Prize winner is automatically and irrevocably deemed to have elected not to receive the home and to have elected to receive the alternate cash prize.  If the Grand Prize winner elects to receive the home, and after making that election does not timely deliver to INNVISION the required withholding amounts or such other items as are necessary to complete the transfer of the home, as determined at INNVISION’s discretion, then INNVISION may award the alternate cash prize instead of the Grand Prize.  The recipient of the home shall accept it through an escrow, without furnishings, in AS-IS, WHERE-IS condition and INNVISION and the home seller have no liability relating to the home or its location.  INNVISION and the home seller give no guarantee, agreement, representation or warranty, express or implied, in connection with the home, including as to its value or that it can be sold for any certain price or within any certain period. The Grand Prize winner acknowledges that government authorities may place a different value on the home than INNVISION placed on the home in determining any income, property, transfer, or other taxes or fees that may be attributable to the home. If there is a tenant in the home then the Grand Prize winner shall allow a reasonable time for the tenant's lease to be terminated and the tenant to vacate the home or shall accept the home subject to that lease.   If the Grant Prize winner elects to receive the home, then he/she shall sign and deliver an agreement of purchase and sale and related escrow instructions within 7 days after these documents are provided to him/her, reasonably cooperate in the escrow process, promptly sign and deliver documents customary for acquiring residential real estate, and cause escrow to close by November 15, 2008.  The Grand Prize winner is solely responsible for paying when due all escrow and title insurance charges, homeowners association dues and assessments, transfer taxes and all other charges imposed in the sale contract and escrow instructions. 

INNVISION has registered this raffle with the Office of the California Attorney General, California Raffle Registration Number RF-0002566.
